Film Review: Seven Psychopaths | Filmophilia

In Seven Psychopaths, Martin (Colin Farrell) is struggling with his screenplay titled ?Seven Psychopaths?. So far, all he?s got is one psychopath. Martin has a friend named Billy (Sam Rockwell) who steals dogs for a living (though he sees himself as more of a dog-borrower) for a guy named Hans Kieslowski (Christopher Walken). One day Billy steals a shit-zu that just happens to belong to a psychopathic mafioso (Woody Harrelson) and somehow Martin gets drawn into the whole messy affair. Along the way he starts getting more ideas for his screenplay.

As ridiculous as that plot description sounds it?won?t?prepare for you for how wonderfully batshit insane this movie is, a better way might be to describe it as Adaptation by way of Quentin Tarantino. No matter how you describe this movie, one things for sure: It?s terrific.

Writer-director Martin McDonagh has been a respected playwright since the 90s but with his directorial debut In Bruges he proved that he also knows how to make a good movie. With Seven Psychopaths he?s avoided the dreaded ?sophomore slump? and made a movie that?s even better than his excellent debut film.

McDonagh has already proven that he has an ear for great dialogue and Seven Psychopath is seemingly stuffed with brilliant, often hilarious dialogue (example: ?You broke his nose!? ?I?didn?t?hit him in the nose, his nose just happened to be where I punched?). But the dialogue?isn?t?merely just clever and funny as McDonagh is playing with various things at once. First and foremost Seven Psychopaths is a very ?meta? and post-modern little crime-comedy (or whatever you want to call it) that plays with genre tropes and clich?s and gets philosophical about all kinds of things. The lead character is clearly based on McDonagh himself (being an Irish screenwriter named Martin) and most likely in some way based on his own experiences on trying to write. Is what we are seeing just what Martin is trying to write?

Christopher Walken along with cute dog in Seven Psychopaths

Even?Christopher?Walken can be cuddly.

The whole thing is a mess structurally speaking but that must be at least semi-intentional, reflecting the difficulty of writing a screenplay. The story has a feeling of being made up it as it goes along but that also means that the film constantly surprises you, freed from the constraints of convention and realism McDonagh seems to simply be doing whatever he damn well pleases and rarely goes about things the typical way.? This makes for a very pleasing viewing experience as it keeps the viewer constantly on his toes.

It?s hard to imagine a cooler cast for a movie. Walken, Waits and Rockwell are three of the coolest people on the planet and Harrelson and?Farrell?are well on their way to getting on that list as well. The standout here is clearly Sam Rockwell. No one is better than him at playing characters that are absolutely repulsive and yet you still fall in love with them. His character is borderline cartoonish at time but he manages to not just be cool, funny and likeable but also brings a bit of pathos and warmth to the character. Somebody give this guy an Oscar, pronto!

Woody Harrelson is also proving more and more how truly great of an actor he is, the goofy bartender from Cheers is long gone. Christopher Walken is his usual cool self but he?s a little more relaxed than usual, playing as sort of wise older guy who?s not all he seems.? Farrell himself may be the least showy here, even though he?s the lead character, and thus perhaps not as memorable as the others but he still does great things with his character. Then there?s Tom Waits whose role is actually quite small but still very memorable, not much of a stretch for Waits but he?s always the coolest of the cool. It?s also worth noting some very solid supporting performances from the likes of Zeljko Ivanek, Harry Dean Stanton, Michael Stuhlbarg and Gabourey Sidibe.

As for the women, they?don?t?get much to do even though two of them are on the poster. Basically, the mostly just serve as props, or plot devices. Abbie Cornish and Olga Kurylenko do what they can but there?s not much there. One female character is pretty much literally a plot device as she appears in one scene and her sole purpose it be killed so the plot can move forward. The movie points out that its female characters are secondary and flat by having a character read Martin?s screenplay and say it outright. Some might say McDonagh is just trying to get away with having female characters that are lacking but it can also be seen that he did this deliberately precisely to point out the problem with Hollywood. His female characters here are clearly secondary. At the very least it makes you think (Farrell says it reflects ?how hard it is for women?, he?s right in a way).

The filmmaking is not flashy here or calls much attention to itself, this is a movie very much about words and characters. Nonetheless it?s very impressive filmmaking. McDonagh fills the movie with gorgeous visuals and the movie looks lovely. He even manages to make a shot of a burnt corpse look somehow poetic. Carter Burwell?s music score also has a part in that.

But what is this movie really about? It throws many things at you and often just seems to be a big joke, or a series of big jokes. And that?s just fine as the movie is entertaining and funny as hell. But there?s definitely more. At the very least Seven Psychopaths can simply be seen as some sort of meditation on the nature of writing and creativity, what it means to tell a good story, and all the elements are simply examples of storytelling and how there?s really no limit to how wild you can go with your imagination. Or maybe it?s just a bunch of goofy wankery. Whatever it is, it works.

Final Verdict: A brilliant, hilarious, consistently clever and surprising crime-comedy with great performances from all the leads. Writer-Director Martin McDonagh avoids the sophomore slump and outdoes himself with a film that?s even better than his excellent debut film, In Bruges. Maybe a little too clever for its own good, and it?s not easy to tell what?s it?s exactly about, but it will be hard to find a more entertaining and funny movie this year.

(AP) ? Jimmie Johnson's expectations are high at Martinsville Speedway, and his results keep showing why.

The five-time series champion raced to his seventh career victory on NASCAR's trickiest oval Sunday, and the triumph helped him erase a seven-point deficit and supplant Brad Keselowski as the points leader with three events remaining.

But before handing Johnson the title, he cautioned, there's plenty of racing yet to do.

"I'm ecstatic about the win today and ecstatic about the points lead, but this is no cake-walk," Johnson said after the 59th victory of his career and fourth this season. "These guys are bringing their best each and every week. ... The next two races will tell the tale. Anything can happen. We could both wad it up next week and Clint Bowyer is your champion."

Johnson moved two points ahead of Keselowski, who finished sixth for his highest career showing at the track. The series next moves to Texas and Phoenix before finishing up at Homestead-Miami.

"I know this championship's going to come down to Homestead," Keselowski said. "You've just got to be in position to where you've got a shot at it and we're doing the things it's going to take."

Both drivers needed only to look at Denny Hamlin's day to be reminded that things can go south fast. Hamlin seemed poised to get in the thick of it, and then had an electrical problem that sent him to a 33rd place finish and out of contention.

"When these things happen, you've just got to suck it up and move on," Hamlin said. "There's nothing I can do about it. One of these days it's going to be our time. It's just not right now."

Keselowski's day was nowhere near as adventurous as Hamlin's, but effective all the same.

He started 32nd, methodically worked his way forward, and was never really a factor until he took a late gamble to grab the lead ? and a crucial bonus point. He was leading the race briefly when a caution flag flew and he and Dale Earnhardt Jr. opted to stay out, then watched as the other 16 lead-lap cars all headed for pit road for fresh tires.

"I think we've learned a lesson here in the past not pitting late, and that certainly came into play," Johnson said. "I felt like it was going to be a problem for him. We've been there before and stayed out and got beat."

When the race went back to green with 19 laps to go, Keselowski was a sitting duck whose best bet was to hang on for as long as he could and then avoid any Martinsville mayhem that cropped up in a furious dash to the finish.

He said the decision to stay out was his own, and he was shocked no one else followed.

"It's at the end of the race and half the field had just pitted 20 or 30 laps ago," Keselowski said. "If I was running 15th, I would have stayed out. I would have put 'em in my shoes and said by golly, I would have stayed out. None of those guys did and I don't know why. Well Dale (Earnhardt) Jr. did. He had some sense. It just wasn't meant to be."

Johnson, who led eight times for 193 laps, passed him on lap 487 on his way to making the race a bonus points bonanza. He got one for leading a lap, one for leading the most laps and three for the victory, wiping out a seven-point deficit.

Busch was second, followed by Kasey Kahne, Aric Almirola, Bowyer, Keselowski, Jeff Gordon and Brian Vickers.

On the final restart, Busch said he was trying to avoid spinning Johnson heading into turn one, but nudged him. Johnson slowed, and Busch too, and "when I went back to the gas, I spun my tires and got loose, and he squirted away from me."

Bowyer also had a great car, leading 154 laps, and Gordon led 92.

While the championship race tightened at the top, it also eliminated Hamlin, who seemed poised to get in the thick of it, and then had an electrical problem that sent him to a 33rd-place finish and out of title contention.

Until the problems arose, Hamlin had put on a clinic about how to pass cars on the 0.526-mile oval.

"When these things happen, you've just got to suck it up and move on," Hamlin said. "There's nothing I can do about it. One of these days it's going to be our time. It's just not right now."

After his first pit stop, Hamlin was penalized for entering pit road too fast, a penalty that moved him to the back of the lead lap, which was 31st. Immediately, he started quickly working his way forward.

After 200 laps, he was contending and actually left pit road with the lead, but again, he was penalized for speeding entering pit road, again dropping him to the back of the lead lap, this time 28th.

He again worked his way into the top five until his problems dropped him 34 laps behind.

Hamlin dropped 49 points off the pace. Bowyer is third, 26 back, and Kahne is 29 back.

Elder Law, Drug and Device Laws and Insurance Laws: Contents of ...

Individual Responsibility: Subtitle F, Part I, is ironically entitled ?Individual Responsibility?. I say ?ironically titled? because Mitt Romney, who believes 47% of the US population takes no individual responsibility, wants to repeal this provision. This is the provision that was upheld by the United States Supreme Court. Under this provision, individuals are fined $750 on their personal tax return if they do not purchase minimal essential health care coverage during a calendar year. This is phased in at a rate of $95 for 2014 and $315 for 2015. If an individual goes one month without minimal coverage the fee is 1/12 of this amount. ?Minimal Essential Coverage? includes Medicare, Medicaid, CHIP, Tricare, Veteran?s plans, and plans for Peace Corp volunteers. It also includes employer-sponsored plans, individual plans and grandfathered plans. Although the penalty is collected on your income tax form, the law expressly prohibits the Federal government from filing criminal charges against you if you don?t pay the penalty and also prohibits the IRS from filing liens and levies against your property to collect the fee. The US Supreme Court debated as to whether it was constitutional for the government to require you to purchase health insurance, and this provision was upheld under Congress?s taxing power. Beginning in 2014, your insurer will send you a formal notice of your coverage for tax purposes. Employers shall also be required to file a return regarding coverage of their employees and also to provide notice to their employees. Assisted Suicide: The law continues on with a prohibition of discrimination against individuals or health care entities on the basis that they refuse to execute assisted suicide, mercy killings or euthanasia. Expansion of Medicaid. The law initially required the states to expand Medicaid by offering it to anyone with an income of %133 of the federal poverty line but the United States Supreme Court struck down this requirement. It is now optional for the states. Children?s Health Insurance Plan (CHIPs): The law enhances funding for this federal program to assist the states in providing health insurance for Children.

CREW Special Report: Excellence Awards Presented to 'Incredible ...

    October 26, 2012

    By Keat Foong, Contributing Editor

    Photo: Keat Foong/CPE

The Commercial Real Estate Women Network awarded its Impact and Circle of Excellence awards yesterday evening during the 2012 CREW Network Convention and Marketplace held in Chicago.

CREW President Diane Butler presented the awards. She noted that women are achieving ?incredible? accomplishments in the commercial real estate field.

The top award, the CREW Network Circle of Excellence Award, went to Elizabeth Solender, president of Solender/Hall Inc. and a former president of CREW Dallas, and the national CREW Network, and to CBRE Global Inc.

Solender founded a 21-year-old company that represents corporations and non-profit organizations seeking to buy, sell, lease, manage or finance real estate, advocating for them with landlords and define their needs. Non-profits are in need of an advocate, being greatly underserved and often presenting challenging situations such as tough working conditions and rough neighborhoods. She was cited by CREW for being ?a change agent? and ?instrumental in the founding of the CREW Foundation, in addition to advancing diversity.

CBRE was lauded for its long-term support of the CREW Network organization and its commitment to diversity in the workplace and CRE Network?s industry research initiative. ?CBRE has been the premier lead partner of CREW Network?s research initiative since it began in 2004,? stated CREW.

Butler also presented the CREW Network Impact Awards, which honor one or more individuals, groups, chapters or companies within each recognized category whose achievements are considered exceptional.

The Network Impact Awards winners, who also received their prizes during the dinner gala, were as follows:

    - Goldie B. Wolfe Miller, president of Millbrook Corporate Real Estate Services. The longtime industry icon and advocate for women in real estate was awarded the Career Advancement for Women award. In addition to encouraging their advancement at her own companies, she formed the Goldie B. Wolfe Miller Women Leaders in Real Estate Initiative in affiliation with Roosevelt University in Chicago.

    - Heather Begneaud McGowan, attorney at law with Stone Pigman Walther Wittmann L.L.C.; Rikki Lober Bagatell, partner with Shutts & Bowen L.L.P.; and Megan Riess, attorney with Fishman Haygood. McGowan, Bagatell and Megan Riess received the Economic Improvement award for their efforts to renovate the Saenger Theatre in New Orleans, a historic property that was badly damaged during Hurricane Katrina. The project required complex financing and changes to the surrounding area (the theater was expanded, among other things, into the street behind it) and was one of only two known projects to obtain HUD approval for ?lump sum? Community Development Block Grant financing, among other achievements.

    - Helena Hauk, president of 5th Gear Consulting. Hauk was awarded for Entrepreneurial Spirit. She has actively worked within the industry as a resource on Small Business Association loans.

    - Allison E. Beall, director of business development for Pacific Building Group, and Irene L. Hosform, partner with Brown McCarroll L.L.P. Beall and Hosform were the recipients of the Member to Member Business award. Both have networked actively to help their own companies as well as fellow CREW members, building longtime relationships and making new partnerships possible.

Commercial Property Executive is a gold sponsor of the event and a CREW Network partner. Look for more on these highly accomplished women?s achievements in the November 2012 issue of Commercial Property Executive, available on CPExecutive.com on Monday, Oct. 29.

The NBC 10 I-Team recently noticed an ad on Craigslist posted by someone who was illegally selling a so-called food stamp cell phone.

A federal law passed years ago allows anyone on any type of public assistance program to get a free or subsidized cell phone, which is paid for by all of us with a special "universal service fee" charge on our phone bills.

The I-Team's hidden camera producer called the number in the Craigslist ad and went to the address in Providence to get the phone.

When the I-Team tried to get some answers from the man who sold us the phone, he was nowhere to be found.

NBC 10's undercover producer paid just $10 for the food stamp cell phone. Selling the phones, which are meant to help those on welfare get jobs and communicate in this high-tech world, is illegal.

This abuse costs all of us more than $1 billion a year.

In May, the I-Team revealed how several residents in Woonsocket were able to get two, three and sometimes four food stamp cell phones, even though those on public assistance are limited to one cell phone per recipient household.

Starting next year, the Federal Communications Commission will have a program in place to crack down on duplicate food stamp cell phones.

"What the Federal Communications Commission has asked is that each company make sure there are no duplicates of service intra-company," said Tom Kogut, a spokesman for the Rhode Island Public Utilities Commission.

But the new program won't do much to stop the selling of the subsidized phones, and all of us will keep on subsidizing them with those extra charges on our phone bills.

Marketers Get Physically Abused for Social Media 'BS' in Adobe Ad ...

Have you ever gotten so enraged by the use of marketing buzzwords that you just want to slap someone? Well, Adobe is attempting to tap into that rage with a $10 million campaign for its social media metrics tools.

The new ad campaign, from Goodby, Silverstein & Partners, builds off the premise that the only way to get straight answers out of such execs is to physically abuse them. In the ad above, for instance, marketers are outfitted with a ?BS detector? that gives execs a painful electric charge whenever they engage in jargon-laden obfuscation. The ad below features a CMO who slaps another exec in the face repeatedly for asserting that ?measuring ROI on social media is a myth.? After a few slaps, the other exec comes around, but then decides, ?I might call the cops.?

Ann Lewnes, CMO at Adobe, told The New York Times that the use of the term ?BS? is a ?bold and provocative way to get attention? from a company that is ?not known for being provocative or bold.? The campaign is aimed at marketers who feel ?misunderstood? and are angry about it, she said. The perception that marketers are full of malarkey with regard to social media came about because of a historic lack of metrics, Keith Anderson, associate partner and executive design director at Goodby, Silverstein, told The Times. However, Anderson argues that Adobe Social tools will make marketers more confident about the efficacy of social as a marketing medium.

Will the target audience buy the pitch? Ian Schafer, the CEO of DeepFocus, says he found the ads ?funny and true.? Schafer agrees that buzzwords can mask marketers? lack of knowledge about an issue. However, Schafer, who has been called to task for his use of jargon, told Mashable that sometimes buzzwords are effective as shorthand ?if two marketers are having a conversation.?

Schafer says that this kind of shorthand is fine in certain situations. ?We?ve all been guilty at some point. When talking to each other, it can be acceptable. But when they make it outside the conference room, it?s unbearable to laypeople, and one of the reasons why marketers are not very respected per that study that came out this week. They are also used as intentionally vague catchalls that don?t lead to any particular point or conclusion.? Schafer says, adding: ?The fact is, buzzwords don?t annoy people, people that use buzzwords annoy people. And the people in these commercials are paying the price.?

Egyptian President Mohamed Morsi Joins Prayer for Destruction of Jews and Their Allies

Um, those allies would include those of us in the United States.

    __________

And we give them?money. (Or, more accurately, we borrow money from the Chinese and then pass it on to the Egyptians.)

Especially galling is when the cleric prays, ?Oh Allah, disperse them, rend them asunder.? After a Jewish diaspora of nearly two millenia that culminated in the Holocaust, how could any decent and educated man pray for this? And to see President Morsi, on his knees, brow furrowed, concentrating and earnestly wishing this fate upon the Jews, is stomach churning.

Part 2 - Syracuse Crunch Coach Jon Cooper - Hofstra University, Coaching, And Steve Yzerman

? ? ?The Norfolk Admirals defeated the Toronto Marlies in the best-of-seven Calder Cup finals four games to zero. ?On June 9, 2012, Jon Cooper and his team were crowned the best of the American Hockey League. ?With little time to savor their winnings, the off-season began, and the Admirals parent club, the Tampa Bay Lightning, relocated thier affilate to Syracuse, New York. ?"We didn't get to enjoy winning the championship as much as maybe we could have", Cooper said. ?" Once we were together in Syracuse in training camp, it was great to sit back, and soak it all in, with all the stories being told".

? ? ?By all accounts, statistical and personal, 2011-2012 was a magical season for Coach Jon Cooper. ?Three months after raising the Calder Cup in Toronto, Cooper was excited to see the guys again. ?"You don't want to forget what you've done, you want to build on it. ?We have set a culture for winning here in Syracuse", Cooper tells during our telephone chat last week.

? ? ?Landing in Central New York for this, the 77th season of the AHL, ?Cooper's story begins in Hempstead, Long Island, while attending Hofstra University. ?While at Hofstra, Cooper played four seasons of Division I lacrosse and one season for the school's hockey club ,while earning a bachelor's degree in business administration. ?Being a hockey fan and with the Nassau Coliseum a short distance from campus, is wasn't any surprise to find Cooper at New York Islanders games. ?During Jon's sophomore year, he remembers being at Islanders games 'all the time'. ?Jon had a connection for free tickets. ?Brad Lauer, last season an assistant coach for the Crunch and currently with the Anaheim Ducks in the same capacity, played parts of ?six seasons with the Islanders. ?Jon and Brad attended high school together. ?

? ? ?After graduation on the Island, Jon was looking for a bigger forum for his future. ?The future AHL coach of the year went on to earn his law degree in Michigan. ?Upon becoming a lawyer, a gradual change became noticeable. ?"Hockey was always in my blood", says Cooper. ?It was when he was working at district court in Lansing with Judge Brennan that Cooper's first coaching offer was presented. ?Jon linked up with a school team that was struggling. ?He worked with the kids during practice, scrimmages, and games. ?As educational the assignment was, Cooper knew that he didn't want to stay at that level in coaching. ?

? ? ?It was when helping out with a Junior-A team, the coaching bug bit Jon hard. ?A non-paying job, Cooper had success behind the bench. ?He had also made a professional move, going into a law practice with a buddy. ?Recalling spending 50 hours weekly ?as a lawyer, and coaching more hours, Jon's winning attracted attention. ?At the time, in his mid-30's, Jon came to the realization that if he were going to make a move to coaching, that was the time. ?The St. Louis Bandits of the NAHL ( North American Hockey League ) in 2006-2007 featured two future Utica College Pioneers on ice. ? Russell Anderson and Mike Leone were tutored ?by Cooper. ?"Mike ( Leone ) was somewhat of a black sheep, when he first came to me", Cooper said. ?"He ( Leone ) was a young, okay player, and when he left, Mike turned out to be one of the best players I have ever coached".

? ? ?Jon remembers Leone as a kid who had many hurdles in life ?and over came them. ?

? ? ?Fast forward to mid-2010, when Tampa Bay came calling. ?After finishing his second season with Green Bay in the USHL ( United States Hockey League ), Jon tells of experiencing two very memorable moments of his hockey career. ?He was flown to Tampa for an interview with Lightning General Manager Steve Yzerman. ?There was a coaching vacancy with Tampa's AHL affiliate in Norfolk. ?After an agent was able to get Jon a ' foot in the door', Jon walked into the Tampa Bay Times Forum for a morning meeting with NHL ?great Yzerman. ?"There's a sign on the door that I'm staring at, Steve Yzerman. ?I'm sitting there by myself. ?Then Steve comes out of his office, calls me by my name, and invites me in", Cooper tells. ?" He ( Yzerman ) was very gracious during our 2 - 3 hour meeting".

? ? ?Jon thinks back about his first one-on-one with Yzerman and remembers that it took about 10 minutes during their conversation to relax. ?"Steve doesn't have an ounce of arrogance in him. ?I've been fortunate that I've never needed a job in hockey. ?Tampa Bay has always treated me as a partner", Jon states. ?When Jon received an offer from the Lightning in 2010-2011 to cooach the Admirals, that was his second ?'holy cow' moment of jubilation. ?And since, the awards and accolades continue coming in a steady stream.

? ? ?Coaching success seems to come way to easy for Jon Cooper. ?All eyes continue to fixate on his educating the NHL stars of tomorrow. ?Enjoy Jon Cooper's work locally, while you can, because his track record says he's due for a move, onward and upward, in the near future.

The Placebo Effect May Be Genetic

The placebo effect seems to make little sense: get ill, take a dummy pill, and you'll recover in much the same way as someone taking real drugs. While there have been many theories bandied about over the years to explain how it works, new evidence suggests that it may be genetic. More »

What Does It Take To Sell Your Own Home? | Bankrate.com

    Selling your own home
    Selling your own home

If you want to sell your own home without parting with thousands of dollars in commissions to real estate agents, consider the for-sale-by-owner, or FSBO, process as a way to save money.

Doug Perlson, founder of RealDirect, a New York City company that helps FSBO sellers market their homes, says many owners who paid top dollar for their properties a few years ago are finding that the drop in real estate prices in the wake of the housing bubble makes it harder for them to come up with the funds for closing.

"A for-sale-by-owner approach is appealing because every dollar saved is that much more important when you're selling for less than you ultimately paid," he says.

In 2011, 10 percent of home sales were FSBO sales, according to the National Association of Realtors. Selling your own home requires more time and effort than working with a traditional agent, says Perlson. But it's worth researching the pros and cons if you seriously want to sell your own home.

Here's a look at factors to consider if you're thinking about selling your own home FSBO.

    Money-saving potential
    Money-saving potential

The biggest reason people sell FSBO is the potential to save money, Perlson says. Sales commission paid to a real estate agent is often as high as 6 percent. Avoiding this fee is the only way many owners can afford to sell, he adds.

Saving money is a huge plus, but there are also some drawbacks to FSBO home sales, says Katie Wethman, a real estate agent in McLean, Va. Owners still have to spend some money upfront, and they also have to spend time and effort marketing their property without a guarantee they will find a qualified buyer.

It's a given that sellers will have to design and print fliers, yard signs and other marketing material on their own. But according to Perlson, it can also cost sellers up to $400 a month to get their home listed in various Internet home sales sites and a local multiple listing service, or MLS.

    A commitment of time
    A commitment of time

Homeowners also have to take time to stage their property, take photos and write descriptions for their listing, Perlson says. Instead of handing the keys to a real estate agent to handle showings and open houses, FSBO sellers are responsible for being available to potential buyers. This can mean staying home on nights and weekends so potential buyers can visit.

"The work and time commitment really comes around showings," Perlson says. Sellers can set their own schedules, so they don't necessarily have to be available every evening. But it is important to be as accommodating to potential buyers as possible, he adds.

    Dealing with low offers
    Dealing with low offers

The seller hopes to save money, but if a buyer makes an offer on an FSBO, it could be lower than what the owner hopes for. "The buyer may want to participate in the savings," Wethman says.

If a potential buyer has his own agent, he may not even consider an FSBO home unless the owner is willing to pay the agent's commission, according to Perlson. That's because the seller's agent would normally split his fee with the buyer's agent, so with a FSBO, the owner takes the place of the seller's agent, he explains. If you agree to the sale, expect to pay around 3 percent of the purchase price to the buyer's agent.

Your net proceeds would lower, but there is a benefit of working with buyers' agents because it can expand your pool of prospects, Perlson says. "If you're going to get the highest possible price, you need to have the most potential buyers."

    Legal disclosures
    Legal disclosures

Even after you agree on a price, you still need to prepare the sales contract, says Shawn Christopher, a real estate attorney in Henderson, Nev. The contract should list the responsibilities of both the buyer and seller, terms of the sale, and how the transfer will take place.

He adds that if you don't disclose problems before the sale, such as a foundation crack, roof leaks or mold, the buyer may try to seek legal action later when they find out about the problem.

This may be avoided if the seller hires an attorney to review their contract and even conduct the closing, he says. Some states require the use of an attorney for the sale. Typically, lawyers charge $300 an hour or more for their services, Christopher says, but the cost of good legal help is worth it.

Potential FSBO home sellers should make sure they research their market and assemble a skilled team to help, Wethman says. "No one thinks they need a professional until something goes wrong."

JBC allows live coverage of interviews of SC justice nominees ...

    InterAksyon.com
The online news portal of TV5

MANILA, Philippines -- The Judicial and Bar Council Monday decided to allow live coverage of interviews of nominees for the position of Associate Justice of the Supreme Court.

The position was vacated with the appointment by President Benigno S. Aquino III of then Associate Justice Maria Lourdes Sereno as the Philippines' 24th Chief Justice on Aug. 24, 2012.

President Aquino has until Nov. 22, 2012 to appoint the next SC Associate Justice.

Last week, the JBC announced it will no longer allow live coverage of the interview unlike during the interview of candidates for the Chief Justice post where it was aired live on various television and radio stations.

"In the interest of transparency and openness, we will allow live media coverage subject to the same rules or set up during the public interviews of Chief Justice candidates," Justice Secretary Leila De Lima told reporters Monday.

De Lima is an ex-officio member of the JBC.

De Lima denied reports the JBC has banned live media coverage of interviews in the Judiciary post.

De Lima said no one has signified interest to cover the interview for the post of SC Associate Justice.

"Kaya naman pala naging ganun ang decision is because of the information na parang wala namang interesado na media network. If the major network would express interest in having it covered live, then we will not deny that for as long as there is only one camera inside," De Lima said.

Following the same guidelines as the candidates for Chief Justice post, only a government station will be allowed to bring in cameras inside the venue, the rest will be asked to hook up.

Scheduled for interview on Oct. 23, 2012 are Court of Appeals Associate Justice Ramon M. Bato, Jr., former University of Perpetual Help System College of Law Dean Jose-Santos B. Bisquera, CA Associate Justice Rosemari D. Carandang and Sandiganbayan Associate Justice Maria Cristina J. Cornejo.

    The JBC will interview on Oct. 25, 2012 former Regional Trial Court Judge Adoracion P. Cruz-Avisado, CA Associate Justices Magdangal M. De Leon, Isaias P. Dicdican, Jose C. Reyes, Jr. and Noel G. Tijam;

Former University of the Philippines College of Law Dean and current Government of the Republic of the Philippines-Moro Islamic Liberation Front peace panel chair Marvic M. Leonen, former Dept. of Energy Secretary Raphael Perpetuo M. Lotilla and CA Presiding Justice Andres B. Reyes, Jr.

The other three candidates, namely, De La Salle University College of Law Dean Jose Manuel I. Diokno, Securities and Exchange Commission Chairperson Teresita J. Herbosa and former Ateneo De Manila University College of Law Dean Cesar L. Villanueva had been interviewed in July 2012 when they were vying for the post of Chief Justice.

(AP) ? Entertainer Andy Williams was remembered Sunday for a smooth voice that could soothe the soul, an inviting smile and a warmth that became synonymous with Christmas as celebrities and fans alike gathered for a memorial tribute at his Moon River Theatre in the southwest Missouri town he adopted as his home.

Williams, who died last month at the age of 84 after a battle with cancer, was serenaded in absentia by a series of musical artists who got their start with him decades ago or had performed with him over the years ? the Lennon Sisters, Osmond Brothers and Gatlin Brothers, among them. Entertainer Bob Newhart choked up with emotion as he joked of his friendship with Williams.

Others sent tributes by video, including comedian Bill Cosby and Ethel Kennedy, who recalled swooning as she once danced with Williams ? a family friend who sang at the memorial for her husband, Robert Kennedy, after his assassination in 1968.

Williams himself also appeared on the video screen as clips recalling his musical albums, TV variety show and Christmas specials were played.

More than 1,000 people attended the tribute hosted by entertainer Peter Marshall that started as an invitation-only event, but was opened to fans as word spread through Branson.

Williams had three platinum and 18 gold records, and five Grammy award nominations during a career that began at age 8 ? when he performed with his older brothers Dick, Bob and Don ? and continued nearly until his death as he performed at his Branson theater named for his signature song, "Moon River."

"For his fans, his music is the tapestry of our lives ? it can soothe life's difficult moments, help to celebrate the glorious ones," said Anthony Gigliotti, who spoke at the memorial service as a representative of Williams' fan club.

Williams became a big star in 1956, the same year as Elvis Presley, with the swing song "Canadian Sunset." He hosted "The Andy Williams Show" through the 1960s into 1971, and the show won three Emmys. His annual Christmas specials, featuring Williams dressed in colorful sweaters singing favorites such as "The Most Wonderful Time of the Year," continued long after his TV show ended and were renewed with live performances after Williams opened his Branson theater in 1992.

"Christmas is never going to be the same to me," Newhart said Sunday, his voice breaking up with emotion.

A cross section of people who knew Williams was seated out of the spotlight in the theater that he built. Some knew him in passing from his friendly smile and wave that graced Branson, and others in a more personal way, including the man who regularly golfed with Williams or the woman who once lived next door to him.

Former neighbor Jude Rhodes recalled Williams holding her sick dog and singing to her for a birthday.

"I could go on for days and days what a wonderful man he was ? a sweet lovely man," Rhodes said.

Williams was passionate not only about singing and entertaining, but about art, architecture, golf and virtually everything he did, his family and friends said.

His older brother Dick drew a standing ovation after singing at the service. Then the 2?-hour memorial tribute closed with a video of Williams singing "May Each Day" ? a tune he often used to close his own shows.

"May each day in the year be a good day. May each day find you happy and gay. And may all of your days be as lovely as the one you shared with me today," Williams sang. "May each day of your life be a good day, and good night."

Then the theater lights went dark. And an audience applauded one final time for Williams.

How does obesity contribute to cancer risk?

PHILADELPHIA Scott Waldman, M.D. Ph.D., chairman of the Department of Pharmacology and Experimental Therapeutics at Thomas Jefferson University, has been awarded one of the prestigious "Provocative Questions" grants from the National Cancer Institute (NCI) , as part of the Institute's ambitious program to tackle the "important but not obvious" questions in cancer to ensure no stone was left unturned after decades of promising research.

Scientists have known for a long time that obesity contributes to cancer risk, but they don't know why.

That's one of the questions set forth by the NCI24 in totalthat Dr. Waldman will help answer with a four-year grant for almost $1.2 million. Out of 700 applicants, just 57 recipients from institutions nationwide were chosen.

For Dr. Waldman, the answers behind cancer and obesity may lie in a hormone receptor known as guanylyl cyclase C (GCC), found mostly in the intestinal tract.

GCC has been established as a suppressor of colorectal cancer tumors and a useful tool to better predict colon cancer risk and recurrence by Dr. Waldman and his team. Preclinical and clinical studies found that lower levels of GCC were associated with an increased risk for colorectal cancer. They also discovered administering GCC reversed that trend.

More recent studies have revealed GCC's role in appetite. The researchers found that silencing GCC affected appetite in mice, disrupting satiation and inducing obesity. Conversely, mice who expressed the hormone receptor knew when to call it quits at mealtime.

Now, under the "Provocative Questions" program, Dr. Waldman will further explore the relationship between cancer and the hormones regulating GCC to get a deeper understanding of the mechanisms of the risk posed by obesityand a possible therapeutic target to treat it.

This is a promising notion, given that one-third of the U.S. population is considered obese, and that obese people have a 50 percent increased risk of being diagnosed with colorectal cancer.

"We are proposing that obesity increases colorectal cancer risk by suppressing the expression of those hormones, and silencing GCC," said Dr. Waldman, "which is an effect that can be reversed by dietary calorie restriction or oral GCC hormone replacement therapy."

There is potential for immediate translation of results to help reduce colorectal cancer risk in obese patients, given that an oral GCC drug to treat constipation just received regulatory approval, added Dr. Waldman, who is a member of Jefferson's Kimmel Cancer Center.

The Provocative Questions project emerged from discussion among a number of veteran cancer researchers that noticed there were many questions some important but not very obvious, some that had been asked but abandoned in the past because there were no ways to study or address them, some sparked by new discoveries or novel technologies that could stimulate the NCI's research communities to use laboratory, clinical, and population sciences in especially effective and imaginative ways.

More than 50 grants, attempting to answer 20 of the 24 proposed questions, with $22 million are being funded this year from that set of applications.
